NYC Department of Consumer Affairs 8th Annual Business Education Day

DCA hosts Business Education Day annually to share compliance tips with New York City businesses instead of issuing fines or violations. Each year, DCA inspectors are joined by dozens of DCA staff, representatives from the Department of Small Business Services (SBS), community organizations, business associations and elected officials to visit more than 1,000 businesses in high-traffic retail areas across the City. Business Education Day teams visit local businesses to point out what could be potential violations, advise owners on how to comply with New York City consumer protection laws and answer any questions business owners and managers may have. Enforcement Rotation at DCA

DCA routinely rotates inspector assignments among the five boroughs to enhance inspectors’ knowledge base while also giving them a new perspective on each borough’s unique issues. New assignments for DCA’s Enforcement Borough Directors are:

Joseph Martino – Chief Borough Directors and Manhattan and Staten Island Borough Director.

Marc Mancusi – Brooklyn Borough Director

Craig Herencia – Queens Borough Director

Richard O’hara – Bronx Borough Director

Tobacco Youth Enforcement Initiative

DCA is seeking to hire teens between the ages of 15 – 17 years old to work in our Undercover Operations Program with the Enforcement Division as Compliance Aides who can work full time at least one day a week – Monday through Friday.  To qualify for the program, teens must be enrolled in school, college, Pre-GED/GED program, or Employment Training Program in good academic standing; be a New York City resident; have signed parental consent forms; have a Certified Copy of Birth Certificate (non-returnable); and have Working Papers.

DCA adds more Financial Empowerment Centers

This summer DCA opened three new Financial Empowerment Centers, bringing free, one-on-one professional financial counseling services to 20 sites Citywide, including a Center in Chinatown that offers counseling in Mandarin and Cantonese. The three new Centers will also offer specialized financial counseling to homeowners in the midst of foreclosure prevention counseling. http://nyc.gov/html/ofe/html/find/find.shtml

The following rule was promulgated by publication in the City Record on April 27, 2010.  The Rule becomes effective May 27, 2010,

NOTICE OF ADOPTION

Notice of Adoption of Rule Regarding Language Assistance Notices to Be Posted at Pharmacies.

NOTICE IS HEREBY GIVEN PURSUANT TO THE AUTHORITY VESTED IN the Commissioner of the Department of Consumer Affairs by Section 20-623 of Chapter 4, Title 20 of the Administrative Code of the City of New York and in accordance with the requirements of Section 1043 of the New York City Charter that the Department promulgates and adopts a rule regarding language assistance notices to be posted at pharmacies.

The rule was proposed and published on March 11, 2010.  The required public hearing was held on April 12, 2010.

RULE

Section 1. Chapter 4 of Title 6 of the Rules of the City of New York is amended by adding new subchapter B to read as follows:

SUBCHAPTER B

LANGUAGE ASSISTANCE NOTICES AT PHARMACIES

§4-11  Content and form of language assistance sign.

(a) The sign required to be posted at chain pharmacies pursuant to §20-623 of the administrative code of the City of New York to inform limited English- proficient individuals of their rights to language assistance in the seven languages identified biennially by the Department of City Planning shall include the following statement in English and in each of the languages listed:  “Point to your language.  Language assistance will be provided at no cost to you.”

(b)  The statement in each of the required languages shall be in 20 point bold faced, Arial type in a color that sharply contrasts with the background color of the sign.  Each such statement shall be enclosed in a box, and there shall be at least a ¼ inch clear space between adjacent boxes.

(c)  The statements in all of the required languages shall be printed on one sign that shall be conspicuously displayed on or at each counter where prescription drug orders are dropped off, where they are picked up, and near every cash register where prescription drugs are paid for.  Such signs shall be positioned so that a consumer can easily point to the statement identifying the language in which such person is requesting assistance.

Statement of Basis and Purpose: Section 20-623 of the Administrative Code of the City of New York, enacted by Local Law Number 55 for the Year 2009, requires that the Commissioner specify by rule the size, style and placement of the sign which must be conspicuously posted by chain pharmacies at or adjacent to each counter where prescription drugs are sold, informing limited English- proficient individuals of their right to obtain language assistance in any of the seven primary languages identified biennially by the Department of City Planning.

The rule specifies the text, format and style of the required sign.  The rule also specifies where such signs are to be located to ensure that they will be easily seen at each point where a prescription drug transaction occurs in chain pharmacies.
